The first US state statute to impose broad duties on developers and deployers of AI systems used in consequential decisions — employment, lending, housing, education, health care, insurance and legal services. It requires reasonable care to protect against algorithmic discrimination, together with impact assessments, disclosure to affected individuals and notification duties.
Unlike the Texas approach, the Colorado duty attaches to discriminatory effect rather than to intent, which brings testing obligations with it.
